The players who choose to not participate in the settlement may then file individual lawsuits on behalf of the league. Dryer hopes that something can be worked out, so that he and his fellow retired players can negotiate a deal with Madden NFL 24 which would directly pay them for the use of their image while leaving them with the rights to it.

"I often conduct deals based on my image as actor and producer," Dryer said. "My persona is my profession. It's my brand. Every person is a brand and has the right to change their brand in a direction they wish to go in.

"I cannot take another's likeness and make use of this to cheap mut coins advance my interests without contacting and paying that person. Then why is it okay that the league can take our rights and not pay us anything?"
